1. The Service

MemeScan is a memecoin scanner that displays real-time decentralized exchange (DEX) market data, trending tokens, filters, watchlists, price alerts, and optional Pro technical indicators. The Service is an informational tool only.

You must be of legal age to form a binding contract and, if using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Not financial advice

All information provided by the Service is for general and educational purposes only. It is not financial, investment, legal, or tax advice, and it is not a recommendation to buy, sell, or hold any asset. Cryptocurrencies are highly volatile and speculative. Any decisions you make are your own responsibility, and you should conduct your own research and consult a qualified professional before making financial decisions.

3. Accounts and acceptable use

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information and keep it up to date.

You must not misuse the Service, including by:

• using the Service for any unlawful, fraudulent, or abusive purpose;
• sending spam or attempting to defraud us or other users;
• infringing the intellectual property or other rights of anyone;
• interfering with or compromising the security or integrity of the Service, including through malware, probing, scanning, or scraping.

4. Intellectual property

The Service, including its software, design, branding, and content (excluding third-party market data), is owned by Moonshot and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms and your selected plan. You may not reverse engineer, resell, redistribute, or circumvent any technical limitations of the Service.

5. Subscriptions and payment

MemeScan Pro is offered as a recurring subscription. Payment, billing, currency, tax, invoicing, cancellation, and refund mechanics are handled by our reseller and Merchant of Record, Paddle. By purchasing, you also agree to Paddle's Buyer Terms. For details on cancellations and refunds, see our Refund Policy.

6. Reseller / Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

7. Service availability and warranties

We do not guarantee that the Service will be uninterrupted, timely, secure, or error-free, and market data may be delayed or inaccurate. To the fullest extent permitted by law, the Service is provided "as is" and "as available", and we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

8. Limitation of liability

To the fullest extent permitted by law, Moonshot will not be liable for any indirect, incidental, consequential, or special damages, including loss of profits, data, or goodwill. Our aggregate liability arising out of or relating to the Service will not exceed the amount you paid us in the twelve (12) months preceding the event giving rise to the claim. Nothing in these Terms excludes liability for fraud, death, or personal injury caused by negligence where such exclusion is not permitted by law.

9. Suspension and termination

We may suspend or terminate your access to the Service for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may stop using the Service at any time. Provisions that by their nature should survive termination will survive.

10. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

11. Governing law

These Terms are governed by the laws of the jurisdiction in which Moonshot is established, without regard to conflict-of-law principles.
